Terms & Conditions
These Terms govern your access to and use of PubliShark.ai and related services.
1. Scope of Service
PubliShark (“we”) provides keyword research, competitor analysis, automation, and reporting tools for authors and publishers. The platform and all associated APIs, documents, and downloadable files are collectively the “Service.” We may update, suspend, or retire features at any time with reasonable notice.
2. Eligibility & Accounts
You must be at least 18 years old and capable of forming a binding contract. You agree to provide accurate information, safeguard your login credentials, and notify us immediately of any unauthorized use. You are responsible for all activity under your account.
3. Subscription Plans, Payments & 7-Day Guarantee
PubliShark offers Starter, Pro, and Publisher Pro plans with monthly or yearly billing. By purchasing, you authorize us (and payment processors such as Stripe) to store and charge your payment method on a recurring basis until you cancel. Each paid plan includes a 7-Day Money-Back Guarantee: if the Service does not meet expectations, contact info@publishark.ai within seven (7) calendar days from purchase for a full refund. Refund requests submitted after the guarantee window, or downgrades/cancellations, take effect at the end of the current billing period unless otherwise required by law.
4. Acceptable Use
You agree not to (a) copy, scrape, or reverse engineer the Service; (b) resell or share access outside your organization; (c) upload malware or unlawful content; (d) use the Service to harass, defraud, or compete unfairly on Amazon or other marketplaces. We may suspend or terminate access if we detect abuse.
5. Intellectual Property
All software, dashboards, AI models, and branding remain the property of PubliShark or its licensors. You retain rights to your own original content, but you grant us the limited right to process it solely to provide the Service. Generated insights and data exports are licensed for your internal business use only.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, process, and share personal data. We rely on vendors such as Supabase, Vercel, and Stripe, which may store data in the EU or United States. By using the Service, you consent to this data processing.
7. Disclaimers, Data Accuracy & Limitation of Liability
The Service is provided “as is.” While we strive to keep data fresh and accurate, third-party sources may fluctuate and may not always reflect real-time results. Insights, scores, and profitability projections are estimates and do not guarantee that any given book or project will earn a specific amount. You are solely responsible for business decisions, creative direction, compliance, and the commercial success or failure of your publications. We are not liable for lost profits, missed opportunities, or other indirect damages. To the maximum extent permitted by law, PubliShark’s total liability for any claim is limited to the amount you paid in the 12 months before the claim arose.
8. Termination
You may cancel anytime via your account settings. We may terminate or suspend access if you breach these Terms or if required by law. Upon termination, you must cease using the Service, but payment obligations accrued before termination remain due.
9. Governing Law & Disputes
These Terms are governed by the laws of Italy, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of Milan, unless mandatory law requires otherwise. You agree to attempt informal resolution with PubliShark before filing a claim.
10. Changes
We may update these Terms to reflect new features, legal requirements, or operational adjustments. When changes are material, we will notify you via email or in-app notice and indicate the “last updated” date. Continued use after the effective date constitutes acceptance.
